Construction projects on industrial sites - pollution challenges

Planning new construction projects, including the construction of industrial halls, requires a geotechnical opinion. This is now a mandatory element of every construction project. Detailed guidelines for the content of the geotechnical opinion are set forth in the Regulation of the Minister of Transport, Construction and Maritime Economy of April 25, 2012 on establishing geotechnical conditions for the foundation of buildings.

Remediation planning at the initial investment or design stage is a key element that can significantly affect the success of the entire project. Early identification and management of potential land contamination not only minimizes financial and legal risks, but also contributes to environmental and public health protection. Environmental research key to optimizing costs and minimizing risks

Investigations of the ground for a future investment are an integral part of any construction process. In addition to the obvious reason for performing them (assessing the suitability and possible options for land development), there is also a legal requirement. It is regulated by Article 34, paragraph 6(2) of the Act of July 7, 1994, Construction Law, which imposes an obligation to comply with the Regulation of the Minister of Transport, Construction and Maritime Economy of April 25, 2012 on the determination of geotechnical foundation conditions for construction objects. The aforementioned decree specifies a number of factors necessary to analyze the subsoil on which the future Investor intends to carry out construction work, including in paragraph 3(1)(10) requiring an assessment of the degree of contamination of the subsoil and the selection of a soil treatment method.
